STANDARD TERMS AND CONDITIONS OF HOLIDAY TENANCY

Please read carefully. The terms and conditions of the holiday rental are as follows. Variation to same by the tenant the agent to refuse keys, amend charges or immediately terminate the occupancy.

All tariffs including security bond are to be paid in full prior to occupancy.

The numbers of occupants MUST NOT exceed six (6).

The property is rented to you for holiday purposes only, for the period stated on the receipt and confirmation letter.

Occupancy is given at 2.00pm on day of arrival. Premises are to be vacated by 11.00am unless otherwise stated on date of departure. Variation in times must be approved by Elders Real Estate. Failure to do so may incur an additional day’s rent being charged.

Keys are to be collected from the Elders Real Estate office by 5pm Monday to Friday. Alternative arrangements are to be made for collections on Saturday, Sunday and weekdays after hours, so please contact the Elders office on (02) 4464 1600.

A fee of $50.00 will be charged when cancellation by a tenant is notified up to 45 days prior to accommodation commencement date. If cancellation is notified within 45 days of accommodation commencement date, the following scale of fees will apply:

45 – 30 days – 25% of total rent (minimum $50.00)

29 - 15 days – 50% of total rent (minimum $50.00)

14 – 0 days – 100% of total rent

If the property is rebooked for the entire period, then a cancellation fee of 15% of the total rent will apply.

UNDER NO CIRCUMSTANCES ARE DOGS OR CATS ALLOWED unless specifically advised.

The booking is made in good faith by us as the agent, however, we cannot be held responsible for actions by an owner, such as changes to a property and or its inclusions or withdrawal of a property, prior to occupancy.

Should a property be required by an owner or withdrawn after a deposit has been taken, every reasonable endeavour will be made to offer alternative accommodation should this situation arise. Alternatively, all monies paid in this situation, will be refunded in full.

With regards to telephone, email and postal enquiries, our descriptions are made in good faith and responsibility for any inaccurate descriptions cannot be taken by us.

As the tenant you are responsible for leaving the premises in a clean and orderly fashion. Please ensure that all dishes etc are cleaned and put away, dishwashers are left empty, lights turned off and all doors and gates locked (where applicable). Your bond will only be refunded within 7 to 14 days following your departure and after the premises are found to be in good order. YOU MUST NOTIFY US OF ALL DAMAGES, BREAKAGES AND LOSS incurred during your occupancy which will be deducted from your bond. If costs exceed bond paid, additional fees will be charged by way of invoice and must be paid immediately upon receipt of same.

Berry Abode is fully equipped with sheets, pillow cases, towels, tea towels etc. Personal items are to be supplied by the tenant.

No responsibility can be taken for tenant’s personal property left on the premises. No responsibility can be taken for tenant's injury while on the property or while using any of the amenities including but not limited to the pool, trampoline, swings and slides, children's cubby house.

No person on the premises shall be guilty of conduct that is a nuisance to adjoining or neighbouring occupiers.

In the event of the property being offered for sale, the tenant agrees to allow the owner or his Agent to inspect the property with prospective purchasers during reasonable hours by appointment.

The tenant agrees to allow the Agent, Owner or nominee to enter the premises to arrange any necessary repairs and or maintenance.

Failure to comply with the above conditions will result in immediate termination of your tenancy.
